USER AGREEMENT

These terms of service will be effective for all users as of February 01, 2025.

GENERAL

  • This User Agreement (“Agreement”) is entered into by and between you (hereinafter referred to as “User” or “you” or “your”) and BeyondÕ Global Services LLP (a limited liability partnership under the Limited Liability Partnership Act, 2008 and bearing LLPIN ACE – 5325 and having its registered office at D2, Level 1, Anmol Palani, No.88, Gopathi Narayanaswami Chetty Road, T.Nagar, Chennai, Chennai, Tamil Nadu, India, 600017 and hereinafter referred to by its trade name as “EduQuest”).
  • This Agreement outlines the terms and conditions governing your enrolment and participation in the online Courses (as defined hereunder) provided by EduQuest and any other ancillary, associated or other services (“Services”).
  • These terms of service constitute the agreement between you and EduQuest and govern your use the Services and your account provided by EduQuest.
  • Before using the Services and enrolling in the Course (as defined below) offered by EduQuest please read carefully all the terms and any other agreement that applies to you which can be found here website terms and Conditions, Privacy policy and  Refunds policy. By enrolling and registering for the Course (as defined hereunder), you agree with all terms and conditions of this Agreement and any other agreements that apply to you, as applicable.
  • We reserve the right to amend, modify, update and change any of the terms contained in the Agreement from time to time. We will notify you of any amendment, modification, update and change by publishing a new version of the Agreement on our website, or by email communication. Any new version of the Agreement will take effect immediately upon publication on our website or the App, and your use of EduQuest’s website/App, or the Services after any changes to the Agreement will be deemed to constitute your acceptance of the Amendments to the Agreement.
  • In the event you do not agree with any changes to this Agreement, you must immediately cease from registering yourself into the Courses (as defined below) available on this platform. By enrolling in the Course (as defined below), you confirm that you have read, understood, and agree to abide by all terms outlined in this Agreement.

DEFINITIONS

  • Amendments”shall mean any changes to this Agreement that EduQuest reserves the right to modify or update terms at any time which shall be notified via email or through announcements on the Course platform.
  • Applicable Law” shall mean any statute, national, state, provincial, local, municipal, foreign, international law, regulation, ordinance, rule, judgment, order, decree, treaty, code, bye-law, clearance, approval, directive, guideline, policy, requirement, or other governmental restriction or any similar form of decision, or determination by, or any interpretation or administration of any of the foregoing by, any governmental authority whether in effect as of the date of this Agreement or thereafter and in each case as amended, as applicable.
  • Business Day” shall mean a day, not being a Saturday or a Sunday, or any day which is a public holiday for the purposes of Section 25 of the Negotiable Instruments Act, 1881, on which banks are open for business in Chennai, India;
  • Cancellation Period” shall mean the cancellation and refund period as specified in EduQuest’s Refund and Cancellation Policy.

  • Cancellation Request” shall mean the email request made by you to EduQuest at EduQuest’s designated support team email ID, i.e., support@eduquest.courses – for cancellation and refund of the Course Fee.
  • Course(s)” shall mean each of the courses / programs offered by EduQuest, individually or as a combo pack, in a phase-wise manner at the discretion of EduQuest, which may, inter alia, include in the program, a series of pre-recorded classes, instructional videos, reading materials and supplementary resources with advanced marketing strategies, theories, and practical applications necessary for navigating the marketing field, the stock market, accountancy fundamentals, etc., and shall also include any and all other courses that may be launched by EduQuest. Each subject area shall be provided as a course individually and can be subscribed to individually or as provided on EduQuest’s website. Course material shall also include educational, and course related material provided to you physically, if any.
  • Course Facilitator(s)” shall mean the Course instructors, tutors and teachers, as the case may be, appointed by EduQuest to teach and guide the Users in relation to the Courses.
  • Course Fee”shall mean the total monetary amount that must be paid to enrol in Course and such fee shall include all taxes, deductions, platform usage fee and any other commissions, as may be under Applicable Law or as determined by EduQuest.
  • Dispute” shall mean any dispute, controversy, claim or disagreement of any kind whatsoever between or among EduQuest, you or any third party in connection with or arising out of this Agreement or the breach, termination or invalidity thereof, as the context may warrant.
  • Duration” shall mean the total length of time allocated for completing the Course, which is set at 1 (one) year from the date of enrolment during which you shall be required to engage with all Course materials and complete any required assessments to achieveCourse objectives.
  • EduQuest’s Intellectual Property” shall mean all Intellectual Property and original content created and provided by EduQuest, whether protected under Applicable Law or not, as part of the Course, including but not limited to its name, videos, written materials, graphics, sounds, music in connection therewith and any other educational resources, provided in such a manner, as a part of the Course.
  • Governing Law”shall mean the Applicable Laws of India.
  • “Intellectual Property” means all intellectual property, including patents, inventions (whether or not patentable and whether or not reduced to practice), trade and service marks, trade names and the goodwill associated therewith, domain names, right in designs, logos, copyrights, rights in databases, proprietary rights, technical, commercial or financial information of a proprietary or confidential nature, trade secrets and knowhow (including manufacturing and production processes and techniques and research and development information), industrial designs, engineering drawings, design drawings, manufacturing drawings, castings and moulding, technical documents, test data, databases and data collections, whether registered or registerable in any territory or jurisdiction.
  • Promotional Period” shall mean the time period as indicated by EduQuest on its website during which the Course will be offered at a discounted rate, which time period, rate, and disclosure shall be at the sole discretion of EduQuest.
  • Referral Scheme” shall mean the codes and / or links which strictly allow for discounted rates for access to the Courses as a part of the promotional scheme offered by EduQuest, at its sole discretion.
  • User Responsibilities” encompasses your obligations and expectations during your enrolment in the Course.

COURSE AND COMPLETION

  • You are encouraged to actively engage with the Course materials and reach out to Course Facilitators for any questions or concerns regarding your progress. EduQuest reserves the right to monitor your engagement and participation in the Course.
  • EduQuest does not guarantee or assume responsibility for the successful completion of the Course or the achievement of any specific outcomes related to the Course content. While EduQuest provides comprehensive educational materials and resources, the responsibility for completing the Course successfully lies solely with you.
  • In the event that you violate any terms outlined in this Agreement or exhibit behaviour deemed inappropriate, EduQuest, at its sole discretion, reserves the right to suspend or terminate your access to the Course and its associated materials without any prior notice. This action may include, but is not limited to, violations of academic integrity, suspicious activity patterns, or non-compliance with Course requirements.
  • You acknowledge that EduQuest shall not be liable for any losses, damages, or claims arising out of or in relation to Clause 3.3 above, including but not limited to processing delays, loss of access to Course materials, or inability to complete assignments. EduQuest maintains no obligation to provide detailed reasoning for its decisions regarding your access and may share information about terminated accounts with any relevant statutory authorities, as may be required under Applicable Laws.
  • Any pending transactions related to Course Fee at the time of any termination in accordance with Clause 3.3 above may be processed or cancelled at EduQuest’s sole discretion. By enrolling in the Course, you agree to these terms and acknowledge that successful completion is contingent upon your active participation and adherence to all guidelines set forth by EduQuest.
  • The Course is intended solely for educational purposes. Its objective is to provide participants with comprehensive knowledge and skills in relations to the topics discussed in the Courses. However, EduQuest in no way promises or assures you that the enrolment in the Course will provide or in any way guarantee job placements or specific employment outcomes upon successful completion. You acknowledge and accept that any career advancement or employment opportunities resulting from the Course are solely your own individual effort and not within the scope of this Agreement or the Course in any manner whatsoever.
  • You will be required to successfully complete the Course within the Duration. The Course shall be accessible on both mobile and desktop versions, ensuring flexibility in how you engage with the Course.
  • EduQuest reserves the right to remove and / or change the Course Facilitators in its sole discretion, as may be required from time to time, without assigning any reason whatsoever to the Users.
  • EduQuest shall make reasonable efforts to ensure that its courses and services are delivered in a timely, professional, and high-quality manner. However, in the event of any deficiency in service, including but not limited to delays, technical issues, content inaccuracies, or incomplete delivery, you may report such issues to EduQuest in writing at support@eduquest.courses within 7 (seven) days from the date of occurrence.
  • EduQuest shall, at its sole discretion, investigate the matter and take appropriate corrective measures, which may include re-delivery of the affected service, extension of course access, or partial/full refund as deemed appropriate. EduQuest’s liability in such cases shall be limited to the amount paid by you for the specific course or service in question. No further claims or damages shall be entertained.
  • Upon successful completion of the Course and assessment by EduQuest, you will be awarded a certificate to recognize your achievement.

ASSOCIATED THIRD PARTY SERVICES

  • Any commitments or promises made by any third parties in relation to the Courses shall not be deemed to be made by EduQuest. Further, unless expressly stated by EduQuest to you, either on its website or in writing to you, all such information available or provided to you by any third parties in relation to EduQuest and its Courses shall not be deemed to be made by or is in any way attributable to EduQuest and EduQuest shall in no manner be liable for such misrepresentations, if any, as the case may be.

PAYMENTS AND COURSE ACCESS

  • Payments to EduQuest may be made through any online net-banking system or mobile banking application, and such payments can be made through the payment gateway provider as housed on the payment page. To ensure proper processing of your enrolment, it is imperative that you include your username and contact details when making the Course Fee payment to EduQuest.
  • You understand that subject to the making of a Cancellation Request during the Cancellation Period in accordance with Clause 8 below, the Course Fee paid by you to EduQuest towards access to the Course is strictly non-refundable.
  • Subject to the Referral Scheme, any promotional offers provided by any bank or payment gateway service provider by way of equated monthly instalments (“EMIs”) or cash back offers on the payment page shall not in any way be deemed to be provided by EduQuest and any Dispute that may arise with regard to such offers or EMIs shall be solely dealt with by you and such bank and payment gateway provider as the case may be.
  • In the event you avail such promotional offer as detailed above, you agree and acknowledge that EduQuest shall not be held responsible by you in any manner whatsoever for any such issue/Dispute that arises therefrom.
  • Upon successful payment, you shall receive from EduQuest a copy of this Agreement acknowledging your acceptance to the terms provided herein and the invoice for your payment.

FEES AND TAXES

  • You authorize EduQuest to charge applicable commissions and platform fees as a part of the total Course Fee as determined by EduQuest from time to time before processing your payment.
  • Early bird registrants will benefit from a discounted rate on the Course Fees, provided you enrol within the specified Promotional Period.
  • All applicable taxes will also be calculated and charged to you at the time of payment of the Course Fee. By enrolling in the Course, you acknowledge that the final amount transferred will reflect such fees and charges.

USER INFORMATION AND RESPONSIBILITIES

  • You authorize EduQuest to share your name and contact details with the Course Facilitators for purposes such as delivering Course materials, addressing queries, and providing updates related to the Course you have enrolled in. You consent to having your name and image displayed in the “Participants” section of the Course you are enrolled in.
  • To enrol in the Course you must be a citizen resident in India and hold a valid and existing Permanent Account Number and Aadhar Card at all times. By providing your contact details, you agree to receive regular updates about future Courses and offerings from EduQuest through newsletters. You have the right to opt out of receiving newsletters and other notifications at any time.
  • You shall, inter alia adhere to the following User Responsibilities:
    • pay the Course Fees to EduQuest in a timely manner. It is expressly provided that your enrolment shall be confirmed only after realisation of the Course Fee;
    • provide requisite details and/or any other information and/or documents as may be required by EduQuest, from time to time, which shall be true, fair, accurate and not misleading;
    • not do anything which may tarnish the name, reputation and goodwill of EduQuest nor use the premises of EduQuest for any act which is illegal, unlawful, immoral and/or against public policy;
    • be responsible for the safe custody of all the drafts, documents, study materials and confidential information received from EduQuest;
    • adhere to instructions of EduQuest and the Course Facilitators in connection with the Course;
    • appear in a presentable manner with strict adherence to the formal dress code for any physical/in-person classes in connection with the Course and not misuse or damage the infrastructure provided at the venue for the Course;
    • not plagiarise, abridge, adapt or otherwise copy the Course material in any manner whatsoever;
    • not use artificial intelligence tools, programs or software in connection with the Course or any connected assessments;
    • not collaborate with other persons for undertaking the Course or any assessments in connection therewith, including having any other person undertake the Course or assessments on your behalf or impersonate you in any manner in communications to EduQuest;
    • not use any other fraudulent/unfair means or methods prohibited/not approved by EduQuest for undertaking the Course including the connected assessments;
    • not aid or assist other users of EduQuest in completing the Courses unless specifically authorized by the Course Facilitators;
    • be bound by and shall comply with the policies, rules,  regulations and code of conduct of EduQuest which are in force at present and/or that may come into force from time to time; and
    • other obligations comprised in other agreements and policies of EduQuest and those notified from time to time by EduQuest.

REFUND & CANCELLATION POLICY

  • EduQuest has a refund and cancellation policy that governs your enrolment in the Courses. If the event you wish to cancel your enrolment, you shall be required to submit a Cancellation Request to EduQuest’s support team during the Cancellation Period. Any refunds will only be processed if the Cancellation Request is received within the Cancellation Period.
  • No refund shall be provided to you upon expiry of the Cancellation Period and in the event you have been provided with access to the Course materials or participated in Course activities, any refunds during this Cancellation Period may be subject to deductions for administrative fees or other charges as deemed necessary at the sole discretion of EduQuest.
  • By enrolling in a Course, you acknowledge and voluntarily accept these terms regarding refunds and cancellations.

GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION

  • Governing Laws: This Agreement shall be governed in accordance with the laws of India. Subject to the Clause 9.2 below, the courts in Chennai, Tamil Nadu shall have the exclusive jurisdiction over all matters of dispute in respect of or arising pursuant to this Agreement.

Dispute Resolution:

  • Any dispute arising out of or in connection with this Agreement shall be first discussed between you and EduQuest, who shall try to settle the issues amicably. In the event an amicable settlement is not arrived at between EduQuest and you within a period of 30 (Thirty) days of notice of dispute, the dispute shall be referred to and finally resolved by arbitration as provided in Clause 9.2.2 below.
  • Any dispute which cannot be settled amicably as provided for above, that is arising out of or in connection with this Agreement including any clause regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Chennai. The arbitral tribunal shall consist of one member who shall be jointly appointed by you and EduQuest. The arbitrator shall make a reasoned award (the “Award”) and such award shall be final and binding on the both you and EduQuest. The seat of arbitration shall be Chennai, Tamil Nadu.

TERMINATION

  • EduQuest reserves the right to terminate your access to the Course and related Services at its sole discretion, without prior notice, for reasons including but not limited to violations of these terms, non-compliance with Applicable Laws, or behaviour that may harm other users or the integrity of the platform.
  • Upon termination, you will lose access to all Course materials and resources associated with your account, including access to the Referral Scheme and you shall also be required to return all physical Course material provided to you, if any.
  • Any pending transactions at the time of termination may be processed or cancelled at EduQuest’s discretion. You acknowledge that EduQuest shall not be liable for any direct or indirect losses or damages resulting from such termination.
  • Survival:  Upon termination of this Agreement, all rights and obligations of both EduQuest and you under the Agreement will automatically terminate except for rights of action accruing prior to termination, payment obligations, and any obligations that expressly or by implication are intended to survive termination. You further agree that the provisions of Clause 9 (Governing Law, Jurisdiction and Dispute Resolution), Clause 11 (Indemnification), Clause 15 (Intellectual Property) and Clause 16 (limitation of liability),  and such other provisions of this Agreement which by their very nature are intended to survive, shall survive the termination of this Agreement.

INDEMNIFICATION

You agree to indemnify and hold harmless EduQuest, its officers, partners, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or related to your breach of these terms or your use of the website, Services and the Course or any act or omission on your part. This includes any claims that may be made by third parties as a result of your actions while using EduQuest’s Services and your engagement with the Course provided by EduQuest.

ELECTRONIC DELIVERY, NOTICE POLICY AND YOUR CONSENT

  • By using EduQuest’s website and enrolling in the Course, you consent to receive electronic communications from us regarding your account and EduQuest’s Services. These communications may include notices about your enrolment status, updates on Course materials, promotional offers, and other relevant information.
  • If you wish to withdraw consent for electronic receipt of any notices as provided for above, you may send a request email to EduQuest’s support team at support@eduquest.courses.
  • By withdrawing your consent to receipt of the notices as stipulated in Clause 12.1 above, you acknowledge that relevant information related to your engagement with the Course shall also be discontinued which may affect your user
  • Notwithstanding anything to the contrary provided herein, in the event you have withdrawn your consent to the notices as provided in Clause 12.1. above, EduQuest shall however not discontinue providing you with essential informational requirements for engaging with the Course you have enrolled in and you hereby provide your consent to receiving such essential information which information shall be determined at the sole discretion of EduQuest.

ENTIRE AGREEMENT AND SEVERABILITY

  • This Agreement constitutes the entire agreement between you and EduQuest regarding your use of the website, the Services and the Course and supersede all prior agreements and / or understandings between you and EduQuest related to this subject matter.
  • If any provision of this Agreement is held to be illegal, invalid, or unenforceable under any present or future law, and if the rights or obligations under this Agreement of you and/or EduQuest are materially and adversely affected thereby:
  • such provisions shall be fully severable;
  • this Agreement shall be construed and enforced as if such illegal, invalid, or unenforceable provision had never comprised a part hereof; and
  • the remaining provisions of this Agreement shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision or by its severance here from;

without prejudice to the foregoing, EduQuest hereto shall provide a legal valid and enforceable provision as similar in terms and effect to such illegal, invalid, or unenforceable provision, as may be possible.

  • No failure to exercise, and no delay in exercising any rights hereunder, shall operate as a waiver thereof, nor shall any single or partial exercise of any such right preclude any other or future exercise thereof or the exercise of any other right.

ASSIGNEMENT / TRANSFER

  • You understand and acknowledge that your enrolment to the Course allows only you to access the Course material and the Services offered on EduQuest’s website.
  • You further agree that you shall not be entitled to, purport to, assign or transfer any or all of your rights and / or obligations under this Agreement, which rights obligations and benefit have been provided solely to you, by your action enrolment of the Course.
  • EduQuest shall be at liberty to assign or transfer this Agreement and any rights and obligations arising therefrom in whole or in part to any other party including its affiliated entities or persons.

INTELLECTUAL PROPERTY

  • You shall not have any right and, or entitlement over EduQuest’s Intellectual Property and you agree to not infringe, recreate, copy, reengineer (with the same idea or approach) and, or reverse engineer EduQuest’s Intellectual Property.
  • You undertake and covenant to protect EduQuest’s Intellectual Property as you would protect your own Intellectual Property. It is further agreed in the event you obtain knowledge or become aware of any violation or infringement of EduQuest’s Intellectual Property, you shall promptly, and not later than 2 (two) days after becoming aware, inform EduQuest of such violation or infringement by way of a written notice to the email ID – support@eduquest.courses. Failure to comply with this Clause shall amount to a breach of this Agreement and be grounds for EduQuest to terminate this Agreement with you and withdraw the provision of the Course, and other related content / Services.

LIMITATION OF LIABILITY

  • Under no circumstances shall EduQuest, its directors, employees, agents, partners, vendors, suppliers, or content providers be held liable under any legal or equitable theory—including but not limited to contract, tort, strict liability, or negligence—for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Course or related Services even if you had been advised of the possibility of, or could have foreseen, such damages. This includes, but is not limited to your use of the website or Services offered on the website, i.e., the Course or any third-party issues faced by you by accessing any third-party website links on EduQuest’s website, etc.
  • Notwithstanding anything to the contrary provided in this Agreement, the maximum liability of EduQuest in relation to any liability under or pursuant to this Agreement shall be capped to the Course Fee. It is hereby clarified that the Course Fee in this Clause 16.2 shall be net of any tax deductions, platform usage fee and any other commissions paid by you at the time of your enrolment and you hereby agree that such fees shall be waived in any Dispute or claim.

REFERRAL SCHEME

  • You as a user of EduQuest’s platform and the Courses may be provided with access to the Referral Scheme of EduQuest.
  • To take part in this Referral Scheme, you shall be provided by EduQuest access to referral codes / links.
  • By taking part in this Referral Scheme, EduQuest agrees to pay you a sum of money, which shall be disclosed to you by EduQuest (“Referral Fee”) for every Successful Referral, which shall be capped at a maximum of 50 (fifty) successful user enrolments each year. A referral shall be deemed successful when a referred user utilises the referral code / link provided to you by EduQuest and successfully pays the Course Fee and thereby enrols in a Course with EduQuest (“Successful Referral”).
  • The Referral Fee shall be paid to you for each Successful Referral upon completion of the refund and cancellation period as specified in EduQuest’s Refund and Cancellation Policy for the referred individual. The Referral Fee shall be paid to your source account from which you had paid your Course Fee or to such bank account as may be communicated by you from your registered email ID to EduQuest’s email ID i.e., support@eduquest.courses.
  • Notwithstanding anything to the contrary, you explicitly agree that EduQuest has the right to withhold the Referral Fee from you, regardless of a Successful Referral, in the event the referred individual, as the case may be, request for a cancellation of enrolment to the Course and refund the Course Fee before expiry of the Cancellation Period. In the event of refund of the fee to the said referred user, you will be provided with adequate notice of the same via email.
  • It is hereby clarified that payment of the Referral Fee for a Successful Referral is subject to applicable deductions under the Income Tax Act, 1961 and Applicable Law, as may be in force from time to time.

GRIEVANCE REDRESSAL

  • In the event the User has any grievances in relation to the Courses, the User shall be required to first reach out to EduQuest at their official grievance redressal email ID i.e., support@eduquest.courses and EduQuest shall ensure timely redressal, to the best of its ability.

FORCE MAJEURE

  • EduQuest will not be liable for any failure or delay in performance under this Agreement due to any event beyond the reasonable control of EduQuest, which could not be reasonably foreseen by EduQuest and could not, by the exercise of reasonable diligence, be prevented by EduQuest, and which event materially affects EduQuest’s ability to perform its obligations under this Agreement, including without limitation, telecommunications failures, labour difficulties, war, riot, act of God, pandemics, epidemics, natural calamities, sanctions, prohibitory orders or government actions. EduQuest shall take all efforts to mitigate the delay and/or losses arising on account of the force majeure event.
